What is measured
The subsolar point is a real, datable place: +23.44° at the June solstice, 0° at the equinoxes, −23.44° at the December solstice, sweeping every latitude between twice a year. Its schedule is the tilt written as a calendar.
What would show this is wrong
an overhead noon Sun observed more than 23.44° from the equator, or solstice/equinox dates the tilt model fails to predict.
